This bill seeks to limit claims of construction defects to actual damage and injury while establishing that claims of potential risk to life, health or safety of the homeowner must be imminent and unreasonable.  Additionally, the bill would restrict claims of construction defects when a contractor has followed all applicable building codes, manufacturer instructions and industry standards.  

SB131 further seeks to repeal certain provisions within current law that expose residential landlords to legal risks that adversely impact rental rates. Notably, the bill repeals recent legislation that expanded liability exposure to landlords relative to habitability of rental property.  The bill also repeals recent legislation that requires mandatory mediation prior to eviction.

Finally, the bill requires local governments to demonstrate that energy codes adopted after January 1, 2026, offer greater economic benefit to the consumer than the cost of compliance.
